  • Let's assume it is unambiguous that the INTENT of the author was to license everything under MPL. Still, the court will have to weigh the intent against the facts. And at least in the contract law, the literal meaning is more important: osborneclarke.com/insights/…. And, of course, in real life the situation may get more complicated because there will be dozens if not hundreds of contributors (each perhaps having his/her own intent).
