The intermediate company should be responsible for make sure the job is done to the customer, and that the employee is paid. And contracts mentioned in the original post are actually illegal in some estates / countries. If the employee couldn't finish the job, for any reason, dead, sick, irresponsible, the intermediate company should be responsible. But, the same goes the way back, when the customer cannot pay.

If money is that important to where you can't approach the client and try to resolve the dispute, then you shouldn't be working as a freelancer. In fact, you shouldn't be working in any position that requires you to negotiate with another party.
